2 illegal immigrants in custody for raping 14-year-old fellow student

UPDATE — 5/5, 2:51 p.m. EDT: State prosecutors in Maryland have dropped criminal charges against two illegal immigrant teenagers accused of raping a 14-year-old female fellow student in a high school bathroom.

Citing a lack of evidence, Montgomery County state attorneys said one of the suspects, 18-year-old Henry Sanchez-Milian, will be charged in juvenile court with possession and distribution of child pornography for sending out images and videos of the alleged victim.

 

Authorities in Rockville, Md., have arrested two illegal immigrant teenage boys for rape and sodomy of a 14-year-old female classmate enrolled at Rockville High School on Thursday.

The suspects, 18-year-old Henry Sanchez Milian, from Guatemala, and 17-year-old Jose Montano from El Salvador, allegedly entered the U.S. illegally in 2016.

According to police reports, Sanchez Milian and Montano met with the victim in a school hallway, approached her and asked her to have sex in the bathroom.  The female student refused to engage with the two attackers and after a second request, the assailants dragged the victim into a nearby bathroom and assaulted her.

The victim revealed to police she repeatedly attempted to free herself of the assailants’ grip, but was restrained and often had her mouth covered and repeatedly pleaded for the attackers stop.

Inside the bathroom the assailants took turns assaulting the girl orally, anally and vaginally and exited the bathroom.  The victim fled the lavatory and notified school staff of the assault.

Although 18 years old, one of the accused, Sanchez Milian, was enrolled as a ninth grader after arriving in the U.S. some seven months ago.  The other alleged attacker, Jose Montano, who reportedly does not speak English, was also enrolled as a ninth grader after arriving from his native El Salvador eight months ago.

At the time of the assault, Sanchez had an illegal alien removal case pending against him.

Appearing in court Friday morning, the pair were charged with first-degree rape and two counts of first-degree sexual offense; both were being held without bail.  Montano is being charged as an adult.

Describing Sanchez as a flight risk when denying bail, District Judge Eugene Wolfe told Sanchez:  “I believe that you are a danger.”

Following the charges filed in court, the Immigration and Customs Enforcement placed an immigration detainer request on Sanchez.
